  1. Introduction

Welcome to Personage.

Personage -“us”, “we”, or “our”- operates the Personage website, mobile application, Instagram, LinkedIn, YouTube, and other interaction by telephone, e-mail, or chat, as well as in-person interactions such as retail store experiences and promotional events. Our Privacy Policy governs your connection with these platforms and the personal information we collect offline, explaining how we collect, use, maintain, safeguard and disclose information that results from your use of our Service. 

By accessing this Website or using our Services, you agree to this Privacy Notice. This Notice may change from time to time. Your continued access to our Website or use of our Services after we make changes are deemed to be acceptance of those changes, so please check the Last Modified Date at the top of this Notice to ensure that you are viewing the current version of this Notice. This Policy is intended to meet requirements globally, including those in North America, Europe, APAC, and other jurisdictions. All individuals whose responsibilities include the Processing of Personal Information on behalf of Personage are expected to protect that data by adherence to this Policy.

We use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used here have the same meanings as in our Terms and Conditions. Your use of our Services, and any dispute over privacy, is subject to this Privacy Statement and our Terms of Use, including its applicable limitations on damages and the resolution of disputes.

  1. Definitions

AGENT means any Third Party that Processes Personal Information pursuant to the instructions of, and solely for us or to which discloses Personal Information for use on its behalf.

COOKIES are small files stored on your device (computer or mobile device).

CONTENT means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Services. 

CUSTOMER is required to login. Customers can do all things that Visitors can do, and can also access their personal account information, post Customer Content and use the Services.

DATA CONTROLLER means a natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your data.

DATA PROCESSORS OR SERVICE PROVIDERS means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.

DATA SUBJECT is any living individual who is the subject of Personal Data.

EMPLOYEE refers to any current, temporary, permanent, prospective or former employee, director, contractor, worker, or retiree of Personage or its subsidiaries worldwide.

PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

PERSSONAL INFORMATION is any information relating to an identified or identifiable natural person or Individual.

PROCESS means any operation which is performed upon Personal Information, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction. 

SENSITIVE DATA or SENSITIVE PERSONAL INFORMATION is a subset of Personal Information which, due to its nature, has been classified by law or by policy as deserving additional privacy and security protections. Sensitive Personal Information includes Personal Information regarding EU residents that is classified as a “Special Category of Personal Data” under US law, which consists of the following data elements: (1) race or ethnic origin; (2) political opinions; (3) religious or philosophical beliefs; (4) trade union membership; (5) genetic data; (6) blood date; (7) biometric data where Processed to uniquely identify a person; (8) health information; (9) sexual orientation or information about the Individual’s sex life; or (10) information relating to the commission of a criminal offense.

SERVICE means the Personage website and mobile application operated by Personage. Through the Services, we help you to build your own pack of grab-and-go supplements and/or vitamins that we deliver to you in packaged boxes on a subscription basis.

THE USER is the individual using our Service. The User corresponds to the Data Subject, who is the subject of Personal Data.

THIRD PARTY is any company, natural or legal person, public authority, agency, or body other than the Individual, Personage or Personage’s Agents.

VISITOR is who does not register with us, but wants to explore the Website. No login is required for Visitors. Visitors can view all publicly-available content on the Website; e-mail us, and chat with us via our website.

USAGE DATA is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit).

USER CONTENT means any Content that Site visitors (including Account holders) provide to be made available through the Services, including Product reviews. It also includes Content that explicitly refers to Personage, the Products or the Services that you submit or make available through third-party websites or platforms (“SNS User Content”). We have no obligation to make any User Content available on the Site.

  1. Information Collection 

We collect Information regarding our current, prospective, and former clients, customers, users, visitors, guests, and Employees. The categories of information we collect is described in more detail below.

3-1. Personal Data

To enable Personage to effectively provide Products/Services to you in the course of registering an Account on our Website, filling out a contact form, and using our Services, we may require or otherwise collect information that identifies you as a specific individual and can be used to contact or identify you. Personal information is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Personally identifiable information may include, but is not limited to: 

  • Registration Information: your name, mailing address, email address, phone number, order history, photographs, username and password for any Personage’s websites;
  • Blood/Genetic Information: your saliva/blood sample, genotypes for specific genetic markers, DNA/blood features, blood type;
  • Lifestyle Information: your age, gender, height, weight, dietary restrictions, ingredient allergies, health concerns, past treatments, exercise habits, physical or mental health or condition, race or ethnic origin, your hobbies, personal interests, and other lifestyle choices and goals;
  • Inferences and Derived Data: your information, data, assumptions, or conclusions that are derived directly or indirectly from another source of Personal Information as we may use statistical techniques to infer additional insights based on Blood/Genetic Information.

Personal Information does not include:

  • Publicly available information from government records;
  • De-identified or aggregated consumer information;
  • Information excluded from the CCPA's scope, like health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data and/or personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

3-2. Purchases Data

When you purchase Products or Services, you must provide us with payment Information, such as your name, email address, postal address that are associated with your debit/credit card. Please note that while we ask for these information on our website, we do not store any payment details or store credit/debit card numbers. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. For future reference and to help us communicate with you, the last 4 digits only of your Credit Card number are kept by us. For any repeat orders of Products made by you via our Site or if you opt in to have your details stored for future payments, our Payment Processing Agency securely holds your Credit Card details and provides us with a unique token that represents that particular card; this token is only valid for payment to us. By submitting your Payment Information, you consent to our providing your Payment Information to those Authorized Third-Party Payment Processors as reasonably necessary to support and process your transactions.

3-3. Surveys Data

From time to time, we may contact you to voluntarily participate in online surveys or in-person interviews and focus groups. If you do decide to participate, you may be asked to provide certain information which may include Personal Information. We may use such information to improve our Products, Sites and/or Services and in any manner consistent with the policies provided herein.

3-4. Promotion and Giveaways

Occasionally we will partner with Third Parties on social media and online channels to sponsor giveaways and promotions. If you choose to share your information in order to participate, your entry information may be shared with such Third Parties.

3-5. Automatic Data Collection

As you navigate through and interact with our Website/App, we and our third-party service providers, including analytics and third-party content providers, may automatically collect certain information from you whenever you access or interact with the Service. This Usage/Device Data may include information such as your device's Internet Protocol address, browser type, operating system, location data, demographic data, time zone, publicly available data, referring/visiting/exit pages, clickstream data, date/time stamp, content response times, the time spent on those pages, unique device identifiers and other diagnostic data. These and the open statistics are used in aggregate form to give us an indication of the popularity of the content and to help us make decisions about future content and formatting.

We may employ third party companies and individuals to facilitate our Service, provide Service on our behalf, perform Service-related services, or monitor and analyze the use of our Service. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

3-7. Third Party Analytics

We use data analytics tools like Google Analytics and other third-party technologies to evaluate usage of our Website and understand how users interact with our advertisements and Services. We also may use other analytic means to evaluate our Website. We use these tools to help us improve the performance of our Website, Services, and user experiences. 3-8. Web Beacons

Also known as pixel tags and clear GIFs, are electronic images that allow a website to access cookies and help track marketing campaigns and general usage patterns of visitors to those websites. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web and app pages. Web Beacons can recognize certain types of information, such as cookie numbers, time and date of a page view, and a description of the page where the Web Beacon is placed. Through Web Beacons, we may collect general information that will not personally identify you, such as: Internet browser, operating system, IP address, date of visit, time of visit and path taken through the Site. We and our third-party service providers also use clear GIFs in HTML e-mails to our Customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

3-9. Cookies

Cookies and other similar technologies are identifiers that enable our Website to provide the Services to you. They are useful because they allow a website to recognise a user's device. We use cookies to collect information on how users navigate our Website, personalize content and provide targeted advertisements through third-party advertising networks when you visit other sites. We use Session and Persistent cookies. Session cookies exist only during an online session and they disappear from your device when you close your browser or turn off your device. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Services to process your online transactions and requests and verify your identity. While, persistent cookies remain on your device after you have closed your browser or turned off your device. We use them to track aggregate and statistical information about user activity. Ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, pixels, LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These cookies and other technologies are governed by each entity’s specific privacy policy, not this one. We may provide these advertisers with information, including personal information, about you.   • to process, analyze, and deliver your Blood/Genetic/Lifestyle Information and Reports;
  • to send you recommendations, Product information, health or wellness-related information;
  • to establish and maintain our business relationship with you;
  • to gather analysis or valuable information;
  • to analyze Site usage and customize the Site’s content;
  • to identify you and, in some cases, to improve and customize the content you see on the Site;
  • to detect, prevent and address technical issues;
  • to fulfill any other purpose for which you provide it with your consent;
  • in any other way we may describe when you provide the information;
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

  • for analytics purposes, including analyzing data, identifying trends and issues and creating statistical reports, analyzing the accuracy and effectiveness of our Website/App and the Services, including administering, troubleshooting, and enhancing and improving the Website and the Services;
  • for other internal purposes, and as otherwise described to you at the time of collection or set forth in this Privacy Policy.

We will assume that you have given your consent to the uses outlined above if you provide us with any data via our websites or via replies to advertisements. If you are concerned about how your information is used, bookmark this page and read this Privacy Policy periodically.

  1. Retention

We need to retain all information indefinitely to Service our Customers and comply with government and industry regulations. But we will retain your Personal Data only to the extent necessary to comply with the purposes set out in this Privacy Policy, our legal obligations, resolve disputes, conduct audits, enforce our legal agreements, pursue legitimate business purposes, and internal analysis purposes unless a longer retention period is required or permitted by law. This means that the retention periods will vary according to the length of time we have an ongoing relationship with you or provide Services to you, the type of the data and the reason that we have the data.

We destroy your physical samples, DNA, and blood after laboratory analysis, subject to legal and regulatory requirements, such as the federal Clinical Laboratory Improvement Amendments of 1988 (CLIA), California Business and Professions Code Section 1265, and College of American Pathologists (CAP) accreditation requirements. We will retain a digital version of these Information within our system for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or permitted by law. 

Usage Data is generally retained for a short period, except when we are legally obligated to retain this data for longer time periods.

Cookies are stored on the device of the visitor and therefore not retained by us. Our cookies may persist on your device and be accessed by our website for up to two years.

Credit card information is not stored directly with Personage.

  1. Transfers

We will take all the steps reasonably necessary to ensure that your information is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are law enforcement or other authorities pursuant to a lawful request. 

All Information, including Personal Data, collected via or by us may be transferred, collected and stored anywhere in the world, including but not limited to, in the United States, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it here. By using our Services, you consent to the transfer/storage of your Personal Information in these locations. 

  1. Disclosure

Personage does not share any personal health information with third parties. We only disclose and share Personal Information with our third-party service providers to help provide you with the Service. Worth to mention in the preceding 12 years, we have not sold any Personal Information. As an example your genetic and blood Information is stored in a de-identified manner using an anonymized barcode system whereby your saliva/blood sample and Information can only be identified using a unique barcode that is stored separately from any personally identifiable information such as your name or email address. Then your saliva samples are automatically destroyed and we do not engage in biobanking. The same applies for your blood sample and results. We do not share Blood/Genetic Information with any third parties other than our CLIA-certified laboratory partner to process your saliva sample. The Privacy Rule protects all "individually identifiable health information" held or transmitted by a covered entity or its business associate, in any form or media, whether electronic, paper, or oral. The Privacy Rule calls this information "protected health information" (PHI). As a result, you are 100% in control of your genetic/blood information. If desired, you can permanently delete your genetic/blood data from your account and our encrypted HIPAA-compliant servers at any time – no questions asked. Please note that once your data is deleted this process cannot be canceled, undone, withdrawn, or reversed.

We have a lot of strict rules for ourselves; but to continue this process legally and to avoid any possible problems, we reserve the common rights of this industry for you and ourselves. We may share your information, including personal information, such as your responses to forms, quizzes, or surveys you submit via the Services, as follows:

  • to a court, government agencies, law enforcement officials, or as otherwise required to by law;
  • to our Laboratory Partner;
  • to vendors, service providers, or other processors, such as customer management providers, IT services providers, data storage providers, technical support providers, customer service providers, payment processors, and shipping providers, to help us provide our Services to you, to assist us in analyzing how our Services are used, and to provide other services;
  • to our affiliates, contractors, subsidiaries, partners, and other third parties as needed to provide the Services to you, support our business, and for other purposes, such as research, analytics and measurement purposes.
  • to promotional and marketing partners that may send you promotional or marketing communications on our behalf, and about their own Products or Services, about the Products and Services of other third parties, or for their marketing, advertising, or analytics and measurement purposes.

We may disclose personal information that we collect, or you provide:

  • due to Law Enforcement, as Under certain circumstances such as to respond to court orders, subpoenas, or other legal processes by authorities with jurisdiction, and if required to do so by law or in response to valid requests by public authorities;

If at our request, you send certain specific submissions or without a request from us you send comments, feedback, creative ideas, suggestions, proposals, plans, or other materials, whether online or offline, by email, by postal mail, by postal address, by phone call, or otherwise, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. However, we will not release your full name on comments publicly. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. Without limiting the generality of the foregoing, we make no warranty that such User Data will be free of any virus, worm, trojan horse, Easter egg, time bomb, cancelbot, or other destructive or malicious code or programs. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Company with respect to the third party and/or User Data that you choose to access, store or distribute, through the Service. If you prefer that we do not share your Personal Information with Third-Party advertising partners or sale of your personal information, you may opt-out of such sharing at no cost by emailing us at cs@Personage.com.

Personage is committed to protecting the privacy rights security of your personal data and information. If you have any questions about the below, please contact us: cs@Personage.com. We follow generally accepted industry standards, and use physical, technical and organizational measures designed to protect your information submitted to us -both online and offline during transmission and once we receive it- against unauthorized access, theft, and loss. Personally identifiable information is stored on computer servers in a controlled environment that is reasonably protected from unauthorized misuse or disclosure. We use available technology and other techniques to implement systems like firewalls, and/or encryption to secure marketing data transfers. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information and orders placed on our website are encrypted using Secure Socket Layer (SSL) technology, an industry standard that is used by vendors to ensure the security of online business. We may offer you the opportunity to participate in contests, giveaways, promotions, and surveys. Any information submitted in connection with such activities will be treated in accordance with this Privacy and Security Policy, except as specifically set forth in the rules for those contests, giveaways or promotions. We restrict access to your Personal Information only to those employees who directly service your Account or perform their job functions. Employees who violate our data security policies are subject to disciplinary action, up to and including termination.

California Privacy Protection Act (CalOPPA) is the first state law in the nation to require commercial websites and online services to post a privacy policy.   • request that we restrict the processing of your personal information;

  • withdraw your consent at any time where we rely on your consent to process your personal information;

Please note that we may ask you to verify your identity before responding to such requests, as we may not able to provide Service without some necessary data.

Although we take precautions intended to help protect the information from loss, misuse, disclosure, alteration, unauthorised access and destruction and takes all reasonable precautions to safeguard the confidentiality of personal information, no system or electronic data transmission is completely secure. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. We do not accept liability for unintentional disclosure. Any transmission of your personal data is at your own risk and we expect that you will use appropriate security measures to protect your Personal Information. You are responsible for maintaining the security of your Account and information. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust, unique password that nobody else knows or can easily guess, and keeping your log-in and password private. Certain content, Products, and Services available via our Service may include materials from third parties, which we neither monitor nor have any control nor input.
